Article 2 : Purpose
The present General Conditions of Sale ("GTCS") regulate the sales of Products made by Nimedix Medical via his Website.
Any order implies the acceptance without reserve of the Customer with the present GTS.
Nimedix Medical reserves the right at any time to change its terms and conditions. Applicable general conditions of sale are those in force on the date of the order.
Section 3 : Products
The Products offered are those described on the Website.
The photographs illustrating the Products are not contractual.
The Customer is invited to consult the description of the Product in order to know the exact characteristics.
The Products are offered within the limit of stocks available.
In case of unavailability of a Product after confirmation of the Order, Nimedix Medical will notify the Customer as soon as possible.
Section 4 : Controls
To place an Order on the Website, the Customer must create an account or checkout as a guest.
The Client must verify the accuracy of the information provided in the Order (the ordered products, delivery information).
Any Order will be considered final after confirmation of payment.
Nimedix Medical reserves the right to cancel or refuse any Order in the event of a dispute with a Customer relating to a previous Order.
Article 5 : Terms of payment
The Customer can pay his Order by credit card via a secure solution, or by bank transfer.
The Order is effective upon receipt of full payment.
An invoice will be sent by email after confirmation of the Order.
Any delay of payment may result in late-payment penalties calculated at the legal rate in force as well as a lump-sum compensation for recovery costs.
Article 6 : Delivery
The products are delivered to l’address indicated by the Customer upon placing the order.
6.1 – Time’shipping and delivery All of our orders require a time of preparation and processing logistics 2 to 3 working days before d’to be handed over to the carrier.
Once the parcel is shipped, delays’routing by our partner Chronopost are the following :
- Metropolitan France : Express delivery in 24h (time total found : 3 to 5 business days after the order).
- Europe and Africa : Delivery between 2 and 6 business days depending on the destination (within total found : 5 to 9 working days after ordering).
6.2 – delivery Charges The delivery costs are calculated automatically based on the total weight of the order and the destination, according to the rates in force Chronopost. The exact amount is indicated to the Customer in his / her shopping cart before the validation.
6.3 – Delay In case of delay of delivery of more than 7 days compared to the announced deadline date, the Customer may cancel the order by email or registered letter.
Article 7 : Complaints
On receipt of the Product, the Customer must verify their status.
Any discrepancy (the product is missing, damaged, damaged package, etc.) must be reported to the carrier and to Nimedix Medical within 3 business days of receipt.
The returned Products must be in perfect condition, in their original packaging, with all accessories.
Article 8 : Right of withdrawal and Returns
In accordance with article L. 221-18 of the consumer Code, the Client has a period of 14 days after the receipt of Product to exercise his right of withdrawal without having to justify reasons or to pay penalties.
8.1 – Procedure of return : To exercise this right, the Customer must notify his decision of withdrawal and return the Products to the’following address : NIMEDIX MEDICAL 88 Rue de Belle-Rive 36000 Châteauroux, France.
8.2 – State of the product : Products must be returned in their state’original and complete (packaging, accessories, instructions,…) to their re-marketing at l’like-new condition. The products with open, damaged, soiled or incomplete will not be accepted. Special Note : For reasons d’hygiene and health protection, the right of withdrawal does s’not apply to products which were unsealed by the Customer after the delivery (article L. 221-28 of the consumer Code).
8.3 – Reimbursement : In case of a valid revocation, Nimedix Medical will reimburse all payments received (in l’except for the return costs which are the responsibility of the Client) using the same means of payment as the one used when the order within a period of 14 days after receipt and verification of the returned products.
Article 9 : Secured
The Products benefit from legal warranties
- Warranty of conformity (article L217-4 and following of the consumer Code)
- Warranty against hidden defects (articles 1641 and following of the civil Code)
In the event of non-compliance, the Customer may request the repair, replacement or refund of the Product, subject to the legal terms and conditions.
Article 10 : Liability
Nimedix Medical will not be held responsible for any damages resulting from any misuse of the Products purchased.
The responsibility of Nimedix Medical is limited to the amount of the Order, unless otherwise provided by law.
Article 11 : personal Data
Nimedix Medical is committed to respecting the privacy of the data communicated by the Customer in accordance with its Privacy Policy available on the Site.
The Customer has a right of access, rectification, opposition and deletion of his personal data by contacting contact@nimedixmedical.com
Article 12 : intellectual Property
All the elements of the Website are and remain the exclusive intellectual property of Nimedix Medical.
No one is authorized to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the Site without the express written consent of Nimedix Medical.
Article 13 : applicable Law – Disputes
The present General Conditions of Sale are subject to French law.
In the event of a dispute, an amicable solution will be sought before any legal action.
Failing amicable agreement, any dispute will be brought before the competent French courts.
