Article 2 : Purpose
The present General Conditions of Sale ("GTCS") regulate the sales of Products made by Nimedix Medical via his Website.
Any order implies the acceptance without reserve of the Customer with the present GTS.
Nimedix Medical reserves the right at any time to change its terms and conditions. Applicable general conditions of sale are those in force on the date of the order.
Section 3 : Products
The Products offered are those described on the Website.
The photographs illustrating the Products are not contractual.
The Customer is invited to consult the description of the Product in order to know the exact characteristics.
The Products are offered within the limit of stocks available.
In case of unavailability of a Product after confirmation of the Order, Nimedix Medical will notify the Customer as soon as possible.
Section 4 : Controls
To place an Order on the Website, the Customer must create an account or checkout as a guest.
The Client must verify the accuracy of the information provided in the Order (the ordered products, delivery information).
Any Order will be considered final after confirmation of payment.
Nimedix Medical reserves the right to cancel or refuse any Order in the event of a dispute with a Customer relating to a previous Order.
Article 5 : Terms of payment
The Customer can pay his Order by credit card via a secure solution, or by bank transfer.
The Order is effective upon receipt of full payment.
An invoice will be sent by email after confirmation of the Order.
Any delay of payment may result in late-payment penalties calculated at the legal rate in force as well as a lump-sum compensation for recovery costs.
Article 6 : Delivery
Products are delivered to the address indicated by the Customer at the time of ordering.
6.1 - Shipping and delivery times All our orders require a preparation and logistics processing time of 2 to 3 working days before being handed over to the carrier.
Once the parcel has been dispatched, delivery times by our partner Chronopost are as follows:
- Metropolitan France : Express delivery in 24h (total delivery time observed: 3 to 5 working days after order).
- Europe and Africa : Delivery between 2 and 6 working days depending on destination (total delivery time: 5 to 9 working days after order).
6.2 - Delivery charges Delivery charges are automatically calculated according to the total weight of the order and the destination, based on Chronopost's current rates. The exact amount is indicated to the customer in the shopping basket before validation.
6.3 - Delay In the event of a delay in delivery of more than 7 days in relation to the announced deadline, the Customer may cancel the order by e-mail or registered letter.
Article 7 : Complaints
On receipt of the Product, the Customer must verify their status.
Any discrepancy (the product is missing, damaged, damaged package, etc.) must be reported to the carrier and to Nimedix Medical within 3 business days of receipt.
The returned Products must be in perfect condition, in their original packaging, with all accessories.
Article 8: Right of withdrawal and returns
In accordance with article L.221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the Product to exercise its right of withdrawal, without having to justify its reasons or pay any penalties.

8.2 - Product status The Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) to enable them to be remarketed as new. Opened, damaged, soiled or incomplete products will not be accepted. Specific note: For reasons of hygiene and health protection, the right of withdrawal does not apply to products unsealed by the customer after delivery (art. L.221-28 of the French Consumer Code).
8.3 - Refunds In the event of a valid retraction, Nimedix Medical will reimburse all payments received (with the exception of return costs, which remain the responsibility of the Customer) using the same means of payment as that used for the order, within 14 days of receipt and verification of the returned products.
Article 9 : Secured
The Products benefit from legal warranties
- Warranty of conformity (article L217-4 and following of the consumer Code)
- Warranty against hidden defects (articles 1641 and following of the civil Code)
In the event of non-compliance, the Customer may request the repair, replacement or refund of the Product, subject to the legal terms and conditions.
Article 10 : Liability
Nimedix Medical will not be held responsible for any damages resulting from any misuse of the Products purchased.
The responsibility of Nimedix Medical is limited to the amount of the Order, unless otherwise provided by law.
Article 11 : personal Data
Nimedix Medical is committed to respecting the privacy of the data communicated by the Customer in accordance with its Privacy Policy available on the Site.
The Customer has a right of access, rectification, opposition and deletion of his personal data by contacting contact@nimedixmedical.com
Article 12 : intellectual Property
All the elements of the Website are and remain the exclusive intellectual property of Nimedix Medical.
No one is authorized to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the Site without the express written consent of Nimedix Medical.
Article 13 : applicable Law – Disputes
The present General Conditions of Sale are subject to French law.
In the event of a dispute, an amicable solution will be sought before any legal action.
Failing amicable agreement, any dispute will be brought before the competent French courts.
